- ItemOpen AccessA roma érdekek megjelenítése a jogalkotásban(Károli Gáspár Református Egyetem Állam- és Jogtudományi Kar, 2013) Rixer ÁdámJelen írás a mai Magyarország egyik legégetőbb és legellentmondásosabb kérdésével, a romák érdekeinek a leggyakrabban a központi közigazgatás által vezérelt – ám értelemszerűen nem csak ott zajló – jogalkotási folyamatokba történő becsatornázásával és ennek intézményes megoldásaival kíván behatóbban foglalkozni. A téma feldolgozása szükségképpen nélkülözi a teljeskörűséget; a létező – s elsősorban a kormányzati döntés-előkészítéssel összefüggő – intézményes megoldások katalogizálásával és az egyes neuralgikus szabályozások és gyakorlatok felmutatásával, illetve néhány vonatkozásban konkrét javaslatok megfogalmazásával e munka csupán a terület növekvő jelentőségére kívánja felhívni a figyelmet. A munka arra is kísérletet tesz, hogy konkrét javaslatai révén rámutasson arra az összefüggésre, miszerint a vizsgált területen is kizárólag körültekintően előkészített komplex közpolitikai programok jogszabályi és közjogi szervezetszabályozó eszközökben történő leképeződése vezethet eredményre; azaz egyes új jogintézményeknek a társadalmi valóságtól és a jogrendszer egyéb területeitől, illetve a jogalkotási folyamat egyéb elemeitől elszigetelt kialakítása, bevezetése nem lehet sikeres, nem produkálhat valós (tartós) társadalmi eredményeket. A tanulmány nagy terjedelemben foglalkozik a társadalmi múlt egyes jogpolitikai és jogtörténeti összefüggéseivel; amennyiben ezek – számos esetben – rendkívüli magyarázó erővel bírnak a jelen jogintézményei és (jog)politkai tendenciái vonatkozásában is. A múltra vonatkozó fejtegetések szükségképpen kiegészülnek továbbá az újabb jogfejlesztés eredményeit általánosító másik hangsúlyos elemmel: a 2010-ben bekövetkezett kormány- és kurzusváltás óta a magyar jogrendszerben és állami (közigazgatási) szervezetrendszerben bekövetkezett konkrét változások összefoglalása is szükségessé vált, amennyiben a dolgozatban vázolt ellentmondások és javaslatok értelmezési kontextusát a hagyományos tendenciák és a valóban újszerű megoldások csupán együttesen adhatják ki. Munkánk további célja, hogy szakmai javaslataival, jobbító szándékú megállapításaival hozzájáruljon a a hazai romapolitika olykor egyensúlyzavaros és hitelességét tekintve is vegyes megítélésű rendszerének javításához, bővítve a rendelkezésre álló jogi és egyéb eszközök tárházát.

- ItemOpen AccessAcademic associations in the field of administrative sciences in Central and Eastern Europe, or what could be the medium-term objectives of the newly established Central and Eastern European Society for Administrative Sciences?(Universitas-Győr Nonprofit Kft., 2022) Rixer ÁdámWhen we search for the significant players of administrative sciences on both the domestic and international level, we find – amongst others, amongst departments of universities, think-tanks and committees of academies of sciences – also organisations that can be treated as parts of civil society, especially scientific societies, particularly scientific associations. My current paper deals exclusively with the latter ones (with scientific associations) and my main goal is to enlist those functions that can be or even should be provided by our newly created Central and Eastern European Society for Administrative Sciences. To provide the catalogue, the elements of which are based on scientific evidence, my paper covers a) the main roles of contemporary scientific associations; b) the general features of Hungarian civil society; c) the names and main features of the contemporary scientific associations in administrative sciences in Hungary; and d) also the results of an international survey conducted among 142 representatives of administrative sciences of 18 countries in our region, especially of those countries which were formerly socialist states. And finally, with the help of these facts collected I aim to show, and offer some fairly new possible functions to invent in the interest of our ’beloved’ Society.
- ItemOpen AccessCivil Society in Hungary(Schenk Verlag GmbH, 2015) Rixer ÁdámOne of the main reasons for which this study has been written is that there is no such paper in English addressing the historical curve and actual problems of non-governmental/nonprofit sphere. The present paper deals with the characteristics of Hungarian civil/non-profit society. The paper focuses on the legal aspects of this topic, but at the same time it takes in consideration the results and the perspectives of other sciences as well. The aim of this volume is to promote the perspectives of scholarly examination of the legal norms regulating the civil society giving viewpoints for research and offering new ways of approach. We consider that besides the presentation of the institutions and phenomena of the civil society, it would be interesting to focus on the characteristics of those areas and domains that have not been treated despite their significance (such an area would be the situation and problems of Hungarian civil societies existing across the borders of Hungary, the role of the churches in the non-profit sector, the problems of the gipsies’ civil society in Hungary).
