dc.description.abstractIn the last decades, the syndicate contract, as a type of contract outside the Civil Code, has acquired a number of functions. The widespread use of this type of agreement has naturally had an impact on case-law. The present study will examine the situations in which syndicate contracts are typi- cally concluded, whether this type of agreement is an adequate response to the legal problems it is intended to regulate, and what dilemmas arise, mainly because our existing law does not yet take sufficient account of the specific features that give rise to syndicates.
