dc.description.abstractE tanulmány az 1875. évi kereskedelmi törvénykönyv kodifikációs jellegzetességeit és későbbi szabályozási hatásait vizsgálja. Megállapítást nyert, hogy e törvénykönyv szabályozván mind a kereskedelmi jog státuszjogi (kereskedelmi társaságok jogállása) mind dinamikus (kereskedelmi szerződések) részét, a korabeli európai kodifikációk (a német 1861. évi Kereskedelmi törvénykönyv, a francia 1807. évi Kereskedelmi Törvénykönyv) magas színvonalán állt. Az általános polgári jog és a különleges kereskedelmi jog a magyar jogforrási rendszerben hagyományosan külön törvényekben volt szabályozva, hasonlóképpen, mint a korabeli más európai jogrendszerekben, követvén a duális kodifikációs módszert. Az általános polgári jog szabályai a magyar kereskedelmi jogban csak akkor nyertek alkalmazást, ha a kereskedelmi törvénykönyv mást, speciálisat nem írt elő. Az új magyar Ptk. (2013) eltérően a kettős kodifikációs módszertől, elfogadván a monista jogfelfogást, egy törvénytestben szabályozza mind az általános (polgári jogi), mind a különleges (kereskedelmi jogi) kapcsolatokat, hasonlóképpen a svájci kötelmi törvénykönyvhöz, az olasz polgári törvénykönyvhöz, és újabban: a holland polgári törvénykönyvhöz. hu
dc.description.abstractThis study examines the codification characteristics of the 1875 Commercial Code. It is established that this code, by regulating both the status law (commercial companies) and the dynamic part (commercial contracts) of commercial law, was on par with the high standards of contemporary European codifications (the German Commercial Code of 1861, the French Commercial Code of 1807). In the Hungarian system of legal sources, general civil law and special commercial law were regulated in separate acts, similar to other European legal systems, following the dualistic method of codification. The rules of general civil law were applied to commercial legal relationships in contemporary Hungarian commercial law – just as in other European legal systems – only if the Commercial Code did not provide for a different, special rule. The new Hungarian Civil Code (Ptk., 2013), departing from the dualistic codification method and adopting the monistic legal concept, regulates both general and special (commercial) legal relationships within a single body of law (the Civil Code), similar to what has occurred in the Swiss Code of Obligations, the Italian Civil Code, and more recently, the Dutch Civil Code.en
