Abstract
A jogügyletek tárgyainak megfelelő értéke számos jogi, filozófiai és etikai kérdést vet fel. Az igazságos ár a középkori skolasztikus filozófiában gyökerező elmélet, amely az ügyletkötések közösségi érdekekkel összhangban álló megvalósulását, az indokolatlan nyerészkedés, a tisztességtelen haszon kiküszöbölését tűzi ki célul, figyelemmel az uzsora általános tilalmára. Az értékek, árak megértéséhez támpontként vizsgálhatók a csereügyletek szociológiai szempontjai is a gazdasági törvényszerűségek mellett. A modern gazdaságokban a piaci ár a döntő, azonban etikai megfontolások érvényesítése, mások személyes körülményeinek értékelése egyéni döntések alapján is lehetséges. A tanulmány célkitűzése ennek megfelelően – a vonatkozó szakirodalom feldolgozásával – az igazságos ár elméletének, történetének és egyes aspektusainak bemutatása.
The appropriate value of the objects of legal transactions raises numerous legal, philosophical and ethical questions. The just price is a theory rooted in medieval scholastic philosophy, which aims to ensure that transactions are carried out in accordance with the interests of the community, to eli minate unjustified profiteering and unfair profit, taking into account the general prohibition of usury. In order to understand values and prices, the sociological aspects of exchange transactions can also be examined as a basis, in addition to economic laws. In modern economies, the market price is decisive; however, the enforcement of ethical considerations and the assessment of the personal circumstances of others are also possible based on individual decisions. The aim of the study is accordingly to present the theory, history and certain aspects of the just price, by processing the relevant literature.
